EU Countries vs Schengen Countries confusion

The flood of migrants from Turkey into Europe with Germany as a desired destination has not slowed appreciably with the approach of winter. Migrants have been arriving in the islands of Greece in the Aegean Sea, where a Greek ferry transports them to the mainland. From there they travely to Macedonia, then north through Serbia. Since then, they turned westward and traveled through Croatia and then into either Hungary or Slovenia. Now, with Hungary's closure of the border with Croatia, they all be directed to travel through Slovenia.
The above statement by John continues the confusion between countries that are treaty members of ( or are candidates to become treaty members of ) one, or more of the EU treaties, and countries that are treaty members of, the Schengen Treaty. The Schengen Treaty Area includes treaty members countries that are not members of the EU, and the Schengen Treaty does NOT, repeat NOT, include all EU Countries, and also does NOT, repeat NOT, include the mandatory participation of all EU countries, who may have signed the various EU treaties, in all the mandatory aspects of the Schengen Treaty. For most countries in the Schengen Treaty Area, the citizens of one country within the Schengen Treaty Area, may pass through a border between any two countries that both belong to the Schengen treaty area without border controls. There are some exceptions, but those exception are not the major problem with John's statement above.

One of the major problems ( major confusions ) created by John's statements above is that neither Serbia, nor Croatia are included in the Schengen Treaty Area. So Hungry enforcing border controls between Hungary and Serbia, or between Hungary and Croatia in no way violates the provisions applying to the prohibition of border controls between countries that are both in the Schengen Treaty Area.

A second major problem ( major confusion ) created by John's statements is that Greece is a full member country of the various EU Treaties and a full member country of the Schengen Treaty, and included in the Schengen Treaty Area, but the Western European elites allow Greece to just ignore it's responsibilities relating making a legal determination as to an asylum seeker's eligibility for asylum in Greece, as to finger printing asylum seekers, and as to registering asylum seekers entering the Schengen Treaty zone through Greece.

A third major problem ( major confusion ) created by John's statement is that the Western European elites are ignoring the requirements of the Schengen Treaty for Greece, but insisting that Hungary treat asylum seekers who MAY HAVE entered through Greece as if they had already been granted asylum, registered and been finger printed in Greece, when neither the asylum seekers, nor the Greeks want to, or in fact do, legally process, register or finger print the vast majority of asylum seekers who enter the Schengen area through Greece and then exit the Schengen area by traveling into the non-Schengen area countries of the Balkans ( Macedonia, Serbia and Croatia ) after passing through Greece.

A fourth major problem ( major confusion ) created by John's statement is that it ignores the reason Greece does not want to go on record as granting asylum to asylum seekers, register and/or finger print the asylum seekers as required by the Schengen Treaty that Greece is a full Treaty Member of: by being the registering country of record of anyone granted asylum in Greece, then Greece becomes responsible for taking that asylum seeker back if the asylum seeker is later deported from another country that is a full treaty Member of the Schengen Treaty,

The fifth major problem ( major confusion ) created by John's statement is that Hungry is not actually closing the border to asylum seekers, but is instead, just following the letter of the law contained in the Schengen Treaty as written, which is that anyone not properly granted asylum, registered and fingerprinted in the country they entered the Schengen Treaty Area through, and that individual is attempting to re-enter the Schengen Treaty area from a country not a member of the Schenegen Treaty srea, must be legally processed as a new applicant for asylum in the Schengen Treaty area, and must be deported if possible or detained ( if it is not possible to deport them ) if they are not approved for asylum by Hungry's legal asylum process.

The sixth major problem ( major confusion ) created by John's statement is that because Serbia is not a member of the Schengen Treaty, and Serbia refuses to take back asylum seekers not granted asylum, from Hungary, for this reason the asylum application process must take place on the Serbian side of the border fence erected by Hungry that now exists between Hungary and Serbia.

The seventh major problem ( major confusion ) created by John's statement is that Hungary is following the Schengen Treaty and the Western European elites are only following the parts of the treaty that match their current political objectives, so Hungry's actions are only punishable in the court of public opinion, and Hungry's actions also raise questions that the Western European elites would prefer were not ask.

Despite your litany of criticisms, my statement was correct:

Closing ANY internal European border is a blow to the Schengen
Agreement, because it throws the entire open-border concept into
doubt, and raises questions about the sustainability of the Schengen
Agreement itself.
